1. Formation of Contract

These Terms and Conditions govern your use of the Food Scan Go mobile app, website, and any related services (collectively, "Food Scan Go").

By downloading, accessing, or using Food Scan Go, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use Food Scan Go.

2. Grant of Rights

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Food Scan Go for your own personal and informational purposes. You must not:

• Decompile, disassemble, or reverse engineer any of the software or algorithms or any component of Food Scan Go;
• Copy, modify, or create derivative works of Food Scan Go;
• Sell, rent, sublicense, or distribute Food Scan Go;
• Use Food Scan Go or any information provided within it for commercial purposes, including but not limited to resale, redistribution, or integration into any commercial product or service.
• Use Food Scan Go for any purpose that is unlawful or prohibited by these Terms.

3. Proprietary Rights

We retain all rights, title, and interest in and to Food Scan Go, including all software, content, and intellectual property. If you submit feedback, suggestions, or other materials to us, you grant us a royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable license to use, modify, and incorporate such submissions without restriction.

4. Limitation of Liability

To the fullest extent permitted by law, Food Scan Go and its creators, developers, affiliates, and licensors are not liable for any direct, indirect, incidental, consequential, or special damages or injuries or harm arising out of your use of, inability to use, or reliance on Food Scan Go or any information provided through it.

5. Warranty Disclaimer

Food Scan Go is provided as an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

6. User Responsibility and Indemnification

You use Food Scan Go at your own risk. You agree to indemnify, defend, and hold harmless Food Scan Go and its creators, developers, affiliates, and licensors from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the app, your reliance on its content, your breach of these Terms, or your violation of any applicable laws.

7. Changes to Services or Terms

We may modify or update Food Scan Go or these Terms at any time at our discretion. Any changes take effect upon posting. Your continued use of Food Scan Go after changes are posted constitutes your acceptance of the updated Terms.

8. Accuracy of Information

While Food Scan Go strives to provide accurate and up-to-date analysis of food ingredients and any related information, the information may contain errors, omissions, or misinterpretations and should not be solely relied upon. Limitations in technologies, including but not limited to OCR, image recognition, and databases, as well as factors such as poor lighting, blurry images, damaged packaging, or very small text, may cause incorrect, incomplete, or missing ingredient analysis. It is your responsibility as the user to verify all ingredient information by carefully reviewing the actual product packaging and labels before consumption or use.

9. No Medical or Nutritional Advice

Food Scan Go is not a medical device and is not intended for diagnosis, treatment, or prevention of any health condition.

Food Scan Go does not provide medical, nutritional, or professional advice. The content is for informational purposes only and is not a substitute for advice from a qualified professional. Always consult with a healthcare provider or nutritionist if you have concerns about dietary choices or allergies.

10. Data Accuracy and Updates

Food regulations, safety standards, and ingredient formulations change frequently and vary by country. Food Scan Go’s database may not reflect the most current regulatory status, recent bans, or updated ingredient formulations. Always verify current information through official government sources, product manufacturers, or regulatory authorities before making dietary decisions, especially if you have food allergies, sensitivities, or dietary restrictions.

11. Regional and Regulatory Variations

Food regulations vary significantly by country and region. Food Scan Go’s information may not reflect local regulations, banned substances, or approved additives in your jurisdiction. You are responsible for understanding and complying with applicable local food laws.

12. Emergency and Allergy Warning

Food Scan Go is NOT designed to identify allergenic ingredients. Food Scan Go is NOT suitable for emergency situations or life-threatening food allergies. If you have severe food allergies, contact local emergency health services immediately. Never rely on Food Scan Go as the sole source for dietary or medical decisions.

13. App Updates and Changes

Food Scan Go may be updated, modified, or discontinued at any time. Features, accuracy, and availability may change without notice. You are responsible for keeping the App updated and understanding any changes to functionality.

14. Privacy and Data Use

Food Scan Go may process images locally on your device to provide ingredient analysis. Images are not uploaded or transmitted to external servers unless explicitly stated in the Privacy Policy.

15. Third-Party Information

Ingredient and additive information is compiled from various sources including regulatory databases and scientific literature. Food Scan Go does not guarantee the accuracy of third-party data and is not responsible for changes in regulatory status or scientific understanding.

16. Age Restrictions and Parental Supervision

Food Scan Go is intended for individuals aged 13 and above. Users under 18 years of age must have parental or guardian consent and supervision when using Food Scan Go. Parents and guardians are responsible for monitoring minors’ use of Food Scan Go and ensuring they understand the limitations and risks associated with relying on App-generated information for dietary decisions. Minors should never make independent dietary choices based solely on Food Scan Go results, especially regarding allergies, medical dietary restrictions, or unfamiliar ingredients.

17. Force Majeure

We are not liable for any delay, failure to perform, or damage resulting from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, acts of terrorism, civil unrest, outages, cyberattacks, or governmental actions.

18. Relationship

Nothing in this Agreement shall be construed to create any employment, agency, joint venture, fiduciary, or partnership relationship between you and Food Scan Go or its creators, developers, affiliates, or licensors. Each party is an independent entity and acts solely on its own behalf.

19. Assignment

You may not assign or transfer this Agreement, or any of your rights or obligations under it, without our prior written consent. We may assign or transfer this Agreement, including in connection with a merger, acquisition, or corporate restructuring.

20. Waiver

Any failure by either party to enforce any provision of this Agreement shall not constitute a waiver of that provision or of any other rights under this Agreement.

21. Governing Law

This Agreement is governed by the laws of the State of Victoria, Australia, without regard to its conflict of law principles.
